By accessing or using EraseAI.io ("Service"), you agree to be bound by these Terms of Service. Please read them carefully.

1. Service Description

EraseAI.io provides browser-based and server-assisted image and PDF processing tools, including but not limited to watermark removal, background removal, format conversion, image resizing, and PDF editing. The Service is provided as-is and subject to change or discontinuation at any time.

2. User Responsibility & Legal Use

You are solely and exclusively responsible for ensuring that your use of the Service complies with all applicable laws, regulations, and third-party rights, including intellectual property and copyright law. By using this Service:

• You represent and warrant that you own the rights to, or have explicit authorization to process, any content you upload or submit.
• You acknowledge that EraseAI.io provides a technical processing tool only, and does not endorse, authorize, or facilitate any infringing use of copyrighted or watermarked material.
• You agree that removing a watermark from an image does not grant you any copyright, ownership, or license to that image.
• You agree not to use the Service to infringe the intellectual property rights of any third party, including stock photo agencies, photographers, designers, or any other rights holders.

EraseAI.io expressly disclaims all liability for any legal claims, damages, losses, or penalties arising from your use of watermark removal or any other feature of this Service. Any legal consequence resulting from misuse is solely your responsibility.

3. One-Time Payment & Access (Core Pass)

The Core Pass is a one-time payment granting access to the designated tools for the operational lifetime of EraseAI.io. "Operational lifetime" means the period during which the Service is actively maintained and accessible. EraseAI.io makes no guarantee of perpetual operation. If the Service is permanently discontinued, access under the Core Pass will cease, and no refund obligation will arise beyond applicable consumer protection laws in your jurisdiction. This is not a lifetime personal guarantee to any individual user.

4. Refund Policy

All sales are final. Refunds may be considered at EraseAI.io's sole discretion within 7 days of purchase in cases of documented technical failure. Contact support@eraseai.io with your order details.

5. Privacy & Data Processing

Browser-based tools process your images entirely within your device. No image data is transmitted to our servers. Server-side tools (PDF processing) transmit your file to our processing infrastructure solely for the purpose of completing your request. Files are deleted from our servers immediately after processing. We do not store, analyze, or share your files. See our Privacy Policy for full details.

6. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind, express or implied. EraseAI.io does not warrant that the Service will be uninterrupted, error-free, or that processing results will meet your expectations.

7. Limitation of Liability

To the fullest extent permitted by law, EraseAI.io's total liability for any claim arising from your use of the Service shall not exceed the amount you paid in the 3 months preceding the claim. Under no circumstances shall EraseAI.io be liable for indirect, incidental, special, punitive, or consequential damages.

8. Acceptable Use

You agree not to use the Service for any unlawful purpose, to upload malicious content, to attempt to circumvent access controls, or to use the Service in a manner that could harm EraseAI.io or other users.

9. Modifications

These Terms may be updated at any time. Continued use of the Service after changes are posted constitutes acceptance. Material changes will be communicated via email to registered users.

10. Governing Law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles.

This Privacy Policy explains how EraseAI.io collects, uses, and protects your personal information. We are committed to GDPR compliance and your right to privacy.

1. Data We Collect

• Account data: Email address, hashed password (if using email login), Google OAuth profile (name, email) if you choose Google sign-in.
• Billing data: Stripe processes all payments. We store only your subscription status and a Stripe customer ID — we never see your full card number.
• Usage data: Number of tool uses per month (for Pro quota enforcement). No behavioral tracking or analytics.
• Images: Browser-based tools never transmit your images. Server-side tools process images in memory and delete them immediately after. We do not store your images.

2. How We Use Your Data

• To authenticate your account and maintain your session.
• To enforce usage limits under your subscription plan.
• To send transactional emails (magic link login, payment receipts) via Resend.com.
• To analyze aggregate site usage and improve the Service via Google Analytics.
• We do not sell, share, or rent your personal data to any third party for marketing purposes.

3. Cookies & Analytics

We use browser localStorage to store your authentication token and track free-tier usage counts on your device. We also use Google Analytics to collect aggregate, anonymized data about site traffic — including page views, session duration, approximate geographic location, and device type. Google Analytics uses cookies to distinguish users. This data helps us understand how people use EraseAI and improve the service. Google Analytics data is processed by Google LLC under their Privacy Policy (policies.google.com/privacy). You can opt out of Google Analytics tracking at any time by installing the Google Analytics Opt-out Browser Add-on. We do not use advertising cookies or run any ad retargeting on this site.

4. Your GDPR Rights (EU/UK Users)

If you are in the EU or UK, you have the right to:

• Access the personal data we hold about you.
• Correct inaccurate data.
• Request deletion of your account and all associated data.
• Object to or restrict our processing of your data.
• Data portability — receive a copy of your data in a machine-readable format.
• Lodge a complaint with your local Data Protection Authority.

5. Data Retention

Account data is retained for as long as your account is active. You may request deletion at any time. Stripe retains billing records as required by law. Processed image data is deleted immediately and never stored beyond the duration of a single processing request.

7. Security

We use HTTPS, JWT authentication, and bcrypt password hashing. Access to our database is restricted to our server infrastructure only. We do not log image content.
